Terms of use
The general terms and conditions of use (referred to as “GTC”) apply to services provided, purchases made and contracts concluded with this webshop Elamiroud.ch, Rue de l'Ohm 10, Biel/Bienne 2504 (referred to as “Elamiroud”).
Elamiroud reserves the right to modify the GTC at any time.
The version of the GTC valid at the time of all transactions applies. It cannot be changed unilaterally at the time of the transaction. These General Terms and Conditions supersede any prior agreements or provisions. Only the provisions provided for by individual contracts that specify these General Conditions take precedence over them.
Offers are for natural or legal persons who have their domicile or registered office in Switzerland.
An offer is valid as long as it appears in our webshop, and this within the limit of available stocks.
Changes in price and assortment are possible at any time.
The images presented in the advertisements, the website, etc., as well as all the information concerning the products (list of ingredients, nutritional values, allergens, etc.) serve as an illustration for information purposes and are in no way contractual. Only the specific indications on the packaging of the product are decisive.
Prices are in Swiss francs “CHF” including VAT (value added tax) and, if applicable, TAR (early recycling tax) included.
The prices displayed in our shop at the time of purchase are final.
A purchase is considered as a request for the conclusion of a contract with Elamioud. No minimum amount is applied when making a purchase.
After paying for your purchase, you will receive a receipt, which confirms your purchase with Elamiroud. You will therefore no longer be able to supplement or cancel the latter. If a purchase is completed, the latter serves as a basis for calculation, however any special offers and discounts valid at the time of purchase are taken into account.
Elamiroud may, without justification, refuse all or part of the purchase. In this case, you will be informed and payments already made will be refunded. Any other claims are excluded, in particular the products not available are not considered to be due. Temporaryly unavailable products cannot be booked.
Elamiroud offers you a partial or complete replacement guarantee with an equivalent product, with a credit for a maximum amount corresponding to the selling price at the time of purchase, or by granting a discount. It is your responsibility to immediately check the purchased products and store them properly. In the event of defects or discrepancies with respect to the order, our customer service should be notified the same delivery day by email to info@elamiroud.ch. Subsequently, only hidden defects may still be the subject of a complaint and must be immediately communicated after their discovery to our customer service. The amount you paid for the defective merchandise is credited to your customer account. We reserve the right to require proof of default.
All payments must be made in Swiss francs (CHF). Electronic payments Credit cards (Visa, Mastercard, American Express) Debit cards and Postcard More various payment methods without cards (Twint, etc.) In case of payment by credit or debit card, the direct debit takes place immediately after processing of the purchase. Purchases on invoice are not available at this time. Refunds, assets, credits: If you are entitled to refunds or assets, they will be credited to your customer account and usable only in our webshop. Elamiroud gift vouchers cannot be sold or auctioned. Only one voucher can be used per purchase.
The Customer expressly accepts:
· To transmit some of your personal data in order to be able to use the Application (surname, first name, email address, private address, telephone number, gender, billing data, date of birth etc).
· To receive practical information, push notifications, advertising messages or promotional offers, Newsletters and automated E-Mails (note: it may unsubscribe at any time and free of charge from the list of recipients receiving this information).
Elamiroud must process and use the data collected at the time of conclusion of the contract in order to fulfil its contractual obligations. Elamiroud takes all necessary measures to ensure data protection in accordance with the legal provisions.
The Customer accepts that his data will be recorded and used in accordance with the contract and is aware that Elamiroud may disclose his data or that of third parties, including abroad, in particular for reasons of storage, marketing or in the event of injunctions from a court or authority. The data necessary for the performance of the service may be transferred to the service partners mandated by the Company and to other third parties.
Data protection legislation applies. The Customer, Elamiroud and their partners undertake to keep secret all information that has been exchanged or acquired in the context of the services performed.
Swiss substantive law applies to the legal relationship between Elamiroud and you (registered customer).
